Access to Information Law: A Key to Promoting Integrity and Transparency in Cambodia

Share this:

Cambodia’s civil society organizations (CSOs) urge the Royal Government of Cambodia (RGC) and the National Assembly to swiftly adopt an Access to Information Law that aligns with international standards and guarantees the right to access information across all sectors in the digital age, particularly information related to public financial management and public procurement.

Nearly two decades after this critically important bill was first drafted, Cambodians remain concerned about their right to access public information. National and sub-national authorities remain reluctant to proactively disclose certain public information, partly because of limited resources, despite international and national principles requiring public institutions to fulfil their responsibilities in sharing information.

In any modern nation, especially one seeking to become a country aspiring to achieve upper-middle-income and high-income status, access to public information is essential for progress. Citizens need information to monitor the performance of their representatives at all levels. Without transparency and access to documents, budgets, public contracts, and reliable financial data, efforts to combat corruption remain limited. Therefore, the Access to Information Law is vital for fighting corruption and promoting integrity in society.

Recently, the RGC disclosed data on national development projects, an important step toward advancing access to information in Cambodia. However, the provision and receipt of public information remain slow, affecting people’s rights and interests, especially on key matters such as major public procurement procedures and contracts, budgets, and public expenditure that directly concern many citizens’ rights and welfare.

CSOs and youth acknowledge the Royal Government’s efforts to promote access to information, particularly at the sub-national level, through initiatives that strengthen good governance at the grassroots level, the social accountability framework, democratic development, and the One Window Service. Civil society organizations also welcome the Government’s commitment to drafting the Access to Information Law. At the 5th meeting with local journalists on 11 January 2023, Samdech Akka Moha Sena Padei Techo Hun Sen, former Prime Minister of the Kingdom of Cambodia, pledged that the Access to Information Law would be adopted “in 2024 or 2025,” and in any case during the 7th parliamentary mandate.

On the occasion of the 2026 International Day for Universal Access to Information (IDUAI), under the theme “The Access to Information Law: Ensuring Information Integrity and Public Financial Management Transparency in Cambodia,” the CSOs’ Access to Information Working Group (A2IWG) respectfully submits the following recommendations to Samdech Moha Borvor Thipadei HUN Manet, Prime Minister of the Kingdom of Cambodia, and the Royal Government and the Parliament:

  • Accelerate passage of the Access to Information Law in line with international standards and complete the process by 2026 or 2027.
  • Clearly define which types of information are considered “confidential” under the Access to Information Law.
  • State ministries, departments, and government bodies should disclose public information, particularly on public procurement, budgets, and public expenditure.
  • Strengthen and establish mechanisms to ensure information is widely shared through all types of media, enabling citizens, youth, persons with disabilities, and indigenous peoples to access it.
  • Protect all citizens who disclose or disseminate truthful information or information that serves the public interest.
  • Promote public awareness of the right to information and encourage people, especially youth, to seek public information that affects community life.
  • Create a more enabling environment for citizens, especially youth, to participate in planning, budgeting, and public procurement processes at all levels
